Vivid Entertainment chiefs are set to release a new porn video featuring Brittney Jones, who claims to have slept with the actor, and have put out a press release for the clip declaring: "Ashton's fans will undoubtedly enjoy seeing what the star himself may have experienced."
Attorneys for the Just Married star claim the association infringes on his "marketable celebrity identity value" and have threatened to take legal action if his name is not removed.
The letter from Robert D. Offer reads, "It is clear that the use of our client's name is a principal selling point of the video, and that Mr. Kutcher's name is being used in order to lure potential customers to buy the video...
"Your conduct has already caused, and will continue to cause, substantial damages to our client. We will advise our client to seek recovery from Vivid... to the fullest extent allowable under law for any damages, costs and/or liability suffered by him."
Vivid boss Steve Hirsch tells TMZ.com, "We received the letter late this afternoon and I immediately forwarded it to my attorney. We will respond accordingly."

Beresford-Redman, who fled Mexico to head home to L.A. shortly after the tragedy, appeared in court on Monday (29Nov10), when his attorney Richard Hirsch argued his client should be freed because authorities failed to file the proper documentation to secure the warrant for his arrest.
Hirsch also claimed the producer was not a flight risk because he had no criminal background and had two children to care for.
But U.S. District Court Judge Susan Segal rejected the motion, stating, "I do not believe he can be awarded with bail for the allegations which he has been alleged... Mr. Redman presents a risk of flight."
A number of major adult entertainment companies halted production last month (Oct10) after the unidentified star received the diagnosis, crippling the porn industry as studio bosses rushed to ensure the safety of film workers.
Executives at Vivid Entertainment have now confirmed production will restart next week (beg15Nov10) after the company's stars went through vigorous testing.
The firm's founder and co-chairman Steven Hirsch says, "We made the decision to halt production as the health and well-being of our performers is of utmost importance to us. We can now confirm that all performers who were on the quarantine list as a result of being exposed to the HIV positive performer have gone through two rounds of testing and the results are negative...
"We will, of course, continue to require recent test results for all performers in our movies and will continue to take all necessary precautions to assure their health and safety."
Rhodes died last week (07Oct10) at a Los Angeles hospital, according to his daughter Laura. Further details regarding his illness had not been released as WENN went to press.
Rhodes was perhaps best-known for shaping 1970s U.S. TV crime dramas Ellery Queen and Delvecchio, which starred Judd Hirsch.
His other producing credits include TV shows Operation Petticoat and Mariah, and small screen films The Return of Frank Cannon and Captive.
Rhodes is survived by his mother, a son, two daughters, a stepdaughter and three grandchildren.

Spencer Pratt revealed he is in negotiations to sell the footage of his wife having sex to Internet porn giant Vivid Entertainment last week (ends20Aug10), and now TMZ.com reports one extract features Hugh Hefner's girlfriend Shannon.
Sources tell the website Pratt came upon the footage while searching through boxes of belongings at his Malibu, California home.
The busty model tells TMZ.com that such a tape does exist - buts she doubts Pratt has it.
And, if he does go through with his plans to sell the sex film as part of a deal with Vivid Entertainment boss Steven Hirsch, she has threatened to sue.
At press time, Shannon had not made an official comment on the sex tape.
