In the documents, which were filed with a court in Brooklyn, New York, and obtained by the New York Daily News, Niederhoffer, 38, alleges tests also found "high levels of arsenic" in her blood.
As part of her custody battle she has included affidavits from friends including movie mogul Harvey Weinstein, who calls her "a loving and devoted mother".
Niederhoffer lost custody of her little boy last month (Jan15) and is fighting to get him back.
Her novel A Taxonomy of Barnacles is set to become a new film starring Alan Rickman, Katie Holmes, Evan Rachel Wood and Zosia Mamet.

American Horror Story is back for its fourth season and once again, changed the setting and characters to keep things fresh. One thing that has made this horror show unique is the fact that it has pulled from American history to create interesting and horrifying characters. We decided to look closer at the 7 storylines in American Horror Story that were inspired by history.
1. Marie Delphine LaLaurie
The Coven was so good and creepy not only because of the amazing casting of Kathy Bates, but because of the character she played. She played Marie Delphine LaLaurie, a woman who is now remembered for being a socialite who took pleasure in torturing and murdering her slaves. Her horrendous actions weren't brought to light until her home was set on fire. She then fleed the city after the public became outraged by her gruesome actions.
2. Jimmy Darling is based on Grady Stiles Jr.
This season Evan Peters takes on the character of Jimmy Darling, a man who is part of the freakshow due to having "lobster hands." The real person who this character is based off of is Grady Stiles Jr. He was born with a congenital disorder called ectrodactyly that gives the appearance of claws. He went on tour in the circus, but he was a dark man. He was reportedly an alcoholic and was convicted of third degree murder for murdering his eldest daughter's fiance, but only got 15 years probation.
3. The Black Dahlia
Going back to the first season it might be hard to sift through and remember each ghost. That season featured a crowded haunted house. But one of the most beautiful ghosts had to be The Black Dahlia played by Mena Suvari. The Black Dahlia, Elizabeth Short, was indeed a real woman whose death made news headlines everywhere. The waitress' dismantled body was found by a housewife. Each corner of her mouth was cut three inches that made her face appear to be smiling. Her killer was never brought to justice.
4. Stevie Nicks was rumored to be a witch in real life
Ever wondered why Misty Day (Lily Rabe) had a weird fascination with Stevie Nicks? Then, Stevie actually made an appearance on the show?! Well turns out back when she was popular there were rumors that she was in fact a witch...because people are idiots. Good thing that Stevie Nicks has a sense of humor and decided to play the part! It made a memorable episode.
5. Twisty The Clown is inspired by John Wayne Gacy
This season didn't add a clown just to torture people with a huge fear of them. This character was actually inspired by a serial killer named John Wayne Gacy, who killed 33 boys and young men. He was found guilty for these crimes in 1980 and executed by leathal injection.
6. The Axeman
Another character from The Coven that was based on a real person is The Axeman played by Danny Huston. The serial killer committed his crimes during 1918-9 in New Orleans. He usually would break into his victims houses through the back door and kill his victims using a razor or axe. It is known that he is a lover of jazz music since he wrote in his letter that he wouldn't harm people who played jazz music in their homes.
7. The world's smallest woman inspired her own character!
Chances are that you recognize Jyoti Amge due to her being the world's smallest woman weighing in to a total of 11 pounds and is 23 inches tall! She undoubtedly inspired her own character, Ma Petit on the show.

Comedy brothers Shawn and Keenan Wayans have hit back at their lawyers over allegations of unpaid invoices, insisting the lawmen carried out services without their clients' authorisation. The acting siblings were named as defendants in a lawsuit filed by bosses at S & E Azriliant in Los Angeles earlier this month (Oct14). The defendants accused the Wayans brothers of failing to settle bills totalling more than $63,000 (£39,400) for legal services provided between 2008 and 2009.
However, the Wayans have now fired back at the allegations in a countersuit, insisting they never entered a written agreement for the company's legal advice or services and only allowed them to prepare "specific income tax returns".
They claim New York-based lawyers Sidney and Evan Azriliant acted without "authorization, agreement or approval" and without the proper permits when they set up multiple firms in California under the brothers' names, and then tried to invoice them for the extra services.
Keenan and Shawn Wayans are seeking a declaratory judgement confirming that they are not liable for the cost of services allegedly performed.
Evan Rachel Wood has sparked rumours she has embarked on a new romance with actress Katherine Moennig after the two were spotted together at an event over the weekend (11-12Oct14). The Wrestler star and Moennig attended the Hammer Museum's annual Gala in the Garden in Los Angeles on Saturday (11Oct14) and editors at the New York Post report the two acted like a couple during the event.
A source tells the publication, "Evan Rachel Wood arrived with Kate Moennig. They were holding hands and looked very much like a couple... (They) kept close all night."
Wood 'came out' as bisexual in 2012, just before she wed British actor Jamie Bell. The couple separated in May (14).
She was previously engaged to rocker Marilyn Manson in 2010.
Jenny Mccarthy's 12-year-old son Evan walked her down the aisle at her wedding to Donnie Wahlberg.
The model-turned-TV personality married the New Kids on the Block star on 31 August (14), and the big day was made even more special as she had her son by her side. McCarthy tells People.com, "He came up to me and said, 'I have the most important job at the wedding', and I said 'You do,' and then the time came where he walked in the door in his little tuxedo... Donnie helped him get dressed, and then he met me and said, 'You ready?' "He put out his little arm, and we walked down the aisle, and the officiator said, 'Who's giving away this girl?' And he raised his arm, 'I am.'"
McCarthy was also thrilled that her son's involvement did not stop there - he also planned a surprise speech for the bride.
She adds, "He grabbed the microphone and said, 'Can I say a few words?' He was like, 'I love my stepdad, I'm so glad for my mom, we're going to make a great family.' And it was really beautiful."
Music legend Diana Ross threw a post-wedding party for her son on Monday (01Sep14) following his weekend (30-31Aug14) wedding to pop star Ashlee Simpson. Evan Ross married Simpson on Sunday (31Aug14) in a private ceremony at his mother's estate in Greenwich, Connecticut, and the festivities continued the following day with a second big bash at the mansion.
Superstar singer Ross threw a "farewell barbecue" for the newlyweds, according to New York Post gossip column Page Six.
The bash was attended by close friends and family and reportedly had a "lavish bohemian theme".
Ashlee Simpson and Evan Ross have tied the knot.
The couple exchanged vows on Sunday (31Aug14) during a private ceremony at the Greenwich, Connecticut mansion of the groom's mum, Diana Ross, according to multiple reports.
The bride's newlywed sister Jessica Simpson served as Ashlee's matron of honour, almost two months after her own wedding to husband Eric Johnson, while her kids Maxwell, two, and son Ace, 14 months, took on the roles of flower girl and ring bearer, respectively. Bronx Mowgli, Ashlee's five-year-old son with ex-husband Pete Wentz, walked his mum down the aisle.
This is actor Ross' first marriage and the second for Simpson, who was married to the Fall Out Boy rocker from 2008 to 2011. Ross proposed to Simpson in January (14) after just six months of dating.
The bride's father, Joe Simpson, was clearly thrilled about the big day, posting a tweet hours before the nuptials, which read, "Today my little girl gets married. Congrats Ashlee and Evan."
Reports suggest Simpson wore a pearl-embellished white wedding dress and $750,000 (GBP441,000)-worth of Neil Lane rubies.
