Actress Kelly Rutherford has been given a glimmer of hope to keep her kids with ex-husband Daniel Giersch in the U.S. after a Los Angeles judge offered to help resolve the German businessman's immigration issues so he can return to America. The former Gossip Girl star has been locked in a bitter custody battle with Giersch since their divorce in 2009, and she recently filed papers asking federal court authorities to overturn a 2012 ruling allowing their two children to live with their father in France.
Rutherford claimed the state official who granted Giersch primary care of seven-year-old son Hermes and five-year-old daughter Helena acted beyond the scope of his power by effectively deporting the youngsters, but she lost her bid during a hearing on Wednesday (13Aug14), when the federal judge claimed he wasn't qualified to make such a ruling.
However, he reached out to the desperate mum and offered to hold a conference call with Rutherford's lawyer and Giersch's legal representative in an effort to find a resolution for the dad's visa problems, reports TMZ.com.
His U.S. visa was revoked in 2012 for undisclosed reasons.
Rutherford has until 19 August (14) to find a solution, otherwise her children must be returned to Giersch in France.
The costly custody battle prompted the actress to file for bankruptcy last year (13).

Fans of classic rockers The Faces had better start praying for the planned full band reunion because frontman Rod Stewart has revealed he won't be touring in five years. The band get together has been on and off for decades, with Stewart pulling out of reunion dates a few years ago, forcing his bandmates to replace him with Simply Red star Mick Hucknall.
But now the plans are on again and Stewart and guitarist Ronnie Wood are working on a comeback.
However, Rolling Stones star Wood had better start speeding up the process - because the singer is considering retiring from the road.
Stewart, 69, tells the Kansas City Star, "Touring is what I do. Nothing compares to it... I prefer getting onstage (to recording). It's an immediate satisfaction, sending an audience home happy. I want to make the most of it.
"Nothing lasts forever. I still have the energy to do it, and I look forward to at least three or four more years of it."
But he's still keen to hit the road with Wood, Ian McLagan and Kenney Jones before he calls it a day, telling the publication, "It will happen, but the ball is in Ronnie's court. When the Stones stop touring, they stop for a long time. So whenever he's finished, I'll be available.
"If we could just keep McLagan quiet for a bit, we could get on with it. But he seems to come out and say the most negative things about me. But Ronnie and me want to do it... He emailed me the other day and said, 'I've got a few nights off. Let's get dinner'. I said, 'I'm on holiday in the south of France'. He said, 'OK, let's wait until we're 78'."
Controversial director Roman Polanski has pulled out of a planned trip to a Swiss film festival following a raft of protests over the decision to hand him a lifetime achievement award. The Chinatown moviemaker was due to pick up the top prize at the Locarno Film Festival in Switzerland this week (beg11Aug14), but the announcement triggered criticism because of Polanski's past.
The 80-year-old Oscar winner has been a wanted man in the U.S. since fleeing to France in the late 1970s, a day before he was due to be sentenced after pleading guilty to having unlawful sex with a minor.
He was arrested in Switzerland in 2009 and threatened with extradition back to America, but was eventually released and allowed to return to his home in France.
Organisers of the event called the storm over Polanski's award "unacceptable interference of some in the artistic liberty of the festival" but the star has now decided not to return to Switzerland.
He says in a statement, "Dear Friends, I am sorry to inform you that having considered the extent to which my planned appearance at the Locarno Festival provokes tensions and controversies among those opposed to my visit, even as I respect their opinions, it is with a heavy heart that I must cancel my visit. I am deeply saddened to disappoint you."
Polanski had also been scheduled to present his new movie Venus In Fur, which stars his wife Emmanuelle Seigner, at the festival and host a film-making masterclass.
