The article accuses Kardashian of embarking on a five-month affair with American footballer Bret Lockett - while she was dating Humphries. Lockett, who is quoted in the story, appears to confirm the allegations - which Kardashian has strenuously denied.
TMZ.com reports the star learned of the tabloid's plans to print the story earlier this week (06Jun11), prompting her lawyer, Dennis Roach, to fire off a stern letter warning that any publication of the salacious claims are, "at a minimum, damaging, defamatory, and an invasion of her privacy".
But In Touch editors ran the article in their latest issue, which hit retailers on Wednesday (08Jun11).
The piece even features what the magazine insists is sexy text correspondence between Kardashian and the footballer.
Kardashian's representative tells the website her attorney now plans to sue the magazine and New England Patriots star Lockett.
It's the second false report about Kardashian in as many weeks - she was recently forced to shoot down reports she's pregnant with Humphries' baby after another magazine took her remarks about starting a family too far.
Yesterday morning, Khloe Kardashian and Kourtney Kardashian sat down with the crew of Fox & Friends to promote the new season of Keeping up with the Kardashians, which premieres this Sunday on E!. Of course Khloe and Kourtney talked about their sister Kim's engagement to Kris Humphries, and verified that the two of them are, in fact, having a race to get pregnant (Kourtney already has one child, Mason, with her boyfriend Scott Disick, and Khloe does not yet have children with her husband, LA Lakers star Lamar Odom). The interview was peppered with rather mundane questions, like "Kourtney, are you going to marry Scott?" and "Is Kim's engagement ring really that big?" And since the exchanges were so boring and irrelevant, viewers found themselves just suffering through the conversation UNTIL they realized that one of Khloe's nipples was kind of visible through her blouse. And if you were bored with the chit chat and resorted to just letting your eyes wander around the screen rather early into the interview, you would have seen that her nipple was out for the entire segment...which was six minutes long. It's almost impossible to find a clip of the entire thing on the internet now, but here's 23 seconds of what went down.

In the league, Humphries has bounced around between a number of teams: Utah Jazz, Toronto Raptors, Dallas Mavericks, New Jersey/Brooklyn Nets and Boston Celtics. The power forward landed in Boston as part of a trade that brought future hall-of-famers Kevin Garnett and Paul Pierce to the Brooklyn Nets, and it was there that Humphries broke out personally and professionally.Humphries was born in Minneapolis, MN to Debra and William Humphries on Feb. 6, 1985. There, he joined his two older sisters, Krystal and Kaela, in the mixed race family. As a boy, Humphries starred in a different sport - swimming. Humphries was also named to USA Today's Super 25 Basketball Team and was one of 10 finalists for the 2003 Naismith Prep Player of the Year.
Although Humphries accepted a scholarship from Duke University, he ended up attending his hometown school, the University of Minnesota (also his father's alma mater), where he made an immediate impact on the hardwood. Humphries was named the 2004 Big Ten Freshman of the Year and named to the All-Big Ten First Team. He was made an Honorable Mention All-American by both the Associated Press and Rivals.com. Humphries led the Big Ten in scoring and rebounding that first season, becoming the first freshman ever to do so. He even set the Minnesota single game scoring record with 36 points.
Clearly, Kris Humphries was ready for the next level. In 2004, the Utah Jazz drafted Humphries with the 14th pick in the NBA Draft. He played there for two seasons before being traded to the Toronto Raptors in 2006, where he helped the team nab its first ever division title. However, in 2009 Humphries was traded to the Dallas Mavericks. The following year he was once again traded, this time to the then New Jersey Nets.
The year 2010 proved to be a big one for Humphries in several ways. Not only did he start to see success with the Nets, but he also began dating Kardashian.
