Richard Franco was taken into custody after allegedly showing up at her estate three times in as many days.
He denied a charge of felony stalking, but prosecutors slapped him with another allegation of residential burglary on Wednesday (27Jul11).
He has pleaded not guilty to the second charge and is due to appear back in court on 4 August (11).

Berry obtained a temporary restraining order against Franco following the terrifying incident, which she claims left her “panicking” and “extremely frightened” for her safety.
If convicted, Franco faces up to three years behind bars for felony stalking, while the burglary charge carries a six-year sentence, according to TMZ.com.
