James’ custody battle affecting young Sunny

The TV personality took to the stand in an Orange County, California courtroom on Tuesday (13Jul10), testifying that his custody trial with Lindemulder is taking its toll on their little girl Sunny.

He said that Sunny “acts out, she’s more agitated (and) she has sleeping problems” since former adult film star Lindemulder was released from a halfway house in June (10) for tax evasion.

James added: “The more contact she has with her mum, the more fear she has to sleep in her own room.”

He also claimed that he fears the worst for Lindemulder, a recovering addict: “I think she (Lindemulder) has yet to hit rock bottom and I fear (when she does) it will involve Sunny.”

The motorcycle mechanic is fighting for the right to take Sunny with him when he moves to Austin, Texas on 31 July (10) to be nearer to his ex-wife Sandra Bullock and their adopted son, Louis.

The Oscar winner, who dumped James after his infidelities were exposed in the press in March (10), has helped raise Sunny.

According to People.com, a court-appointed lawyer for Sunny testified that the move would benefit her.
