Katie Holmes’ lawyer denies reports of emergency hearing

A lawyer for Katie Holmes has denied reports the actress demanded an emergency custody hearing in her divorce from Tom Cruise on his 50th birthday on Tuesday (03Jul12).

The former Dawson’s Creek star was said to have filed an application in New York, which could have resulted in a public court hearing, to set up a temporary child support agreement for the estranged couple’s six-year-old daughter Suri.

Now her attorney Jonathan Wolfe has spoken out to set the record straight, telling People.com, “There is no such filing at this time. Other than her action for divorce, the only pending application filed by Ms. Holmes remains her request for an anonymous caption.”

An anonymous caption would allow papers filed in ongoing legal proceedings to be kept out of the public domain.

Holmes filed to end her five-year marriage on Thursday (28Jun12), and is reportedly seeking sole legal custody and primary physical custody of Suri.
