Lindsay Lohan Files Countersuit to 2005 Car-Crash Claims

HOLLYWOOD - Lindsay Lohan has filed a countersuit against the alleged victim of her 2005 Hollywood car crash, claiming driver Raymundo Ortega was the one responsible for the accident.

Ortega, who filed a negligence lawsuit against Lohan in Los Angeles in June, claims the actress had been drinking at celebrity hotspot The Ivy before crashing her Mercedes-Benz into his red van in October 2005.

But the Mean Girls star is fighting the accusations with her own court action--alleging Ortega and a number of unspecified defendants caused the crash.

And according to the papers filed at the Superior Court on Thursday, Lohan claims Ortega was "negligent in the ownership, operation, repairs and maintenance" of his vehicle.

She says Ortega made an illegal u-turn in front of her car, causing her to hit the brakes--but failed to stop in time, despite traveling just 30 mph.

She is seeking damages of $75,000 from Ortega.

Lohan's counter-claims come exactly one month after a Los Angeles Superior Court judge rejected the 21-year-old's request to have Ortega's lawsuit dismissed on the grounds of lacking legal sufficiency.

A trial date of April 7 has been set for both cases.
