Report: Stern Will Give Up Custody If Birkhead Is Dad

HOLLYWOOD - Anna Nicole Smith's former companion Howard K. Stern won't challenge paternity rival Larry Birkhead for custody of the tragic model's child--if the photographer is named the baby's biological father.
A DNA test was carried out last month and results are expected to be released tomorrow.
And sources tell Web site TMZ.com that Stern, who has been acting as baby Dannielynn's guardian since her mother died in February, won't challenge Birkhead's custody claim if he wins the paternity battle.
The source says, "If Larry Birkhead is confirmed to be Dannielynn's biological father, Howard will not challenge custody. His love for her will not change, irrespective of the results.
"Howard will act in Dannielynn's best interest, because he loves her and would want a smooth transition to protect her, as she is deeply bonded to those who have been with her since birth.
"Howard will do whatever is necessary to assist Larry Birkhead to defeat any effort by (Smith's estranged mother) Virgie Arthur to obtain custody of Dannielynn."
Arthur, a former police officer, is currently fighting Stern for custody of her granddaughter.
