Students Lose 'Borat' Lawsuit

HOLLYWOOD - Two male students who appear in Borat: Cultural Learnings of America for Make Benefit Glorious Nation of Kazakhstan making racist remarks have had their lawsuit to get the scene cut from the movie dismissed.

The two unnamed South Carolina students had alleged they were plied with alcohol and tricked into making the onscreen comments, and were made to sign release forms while drunk.

They were seeking damages for distress caused by their appearance, and wanted the scene axed from the film and its subsequent DVD release.

Last week, the pair were given another opportunity to seek an injunction.

However, Los Angeles Superior Judge Joseph Biderman yesterday ruled they had failed to show a reasonable probability of success on the merits of their case and that monetary damages would not be enough to resolve their claims.
