Chris Brown and Rihanna may have kissed at the MTV Video Music Awards back in September, but just because they have made up doesn't mean that Brown is done with probation. In June 2009, Brown plead guilty to felony assault against his then girlfriend Rihanna, and he is still on probation over three years later. On Monday, the 23-year-old singer appeared in court for a probation hearing; during that hearing, evidence surfaced that Brown had failed a drug test on June 18 in Virginia where he was working on his court mandated community service hours, TMZ reports.
But because Judge Patricia Schnegg never said that Brown had to undergo drug testing as part of his probation, she let the offender slide on by. She reportedly only reminded him not to break the law.
A probation report cites that Brown had told his probation officer that he had a medical marijuana prescription card and smoked the weed in California, where it's legal to do so. He then allegedly failed the drug test in Virginia, where smoking pot is against the law.
Besides this recent offense, Judge Schnegg has ordered for the case to be moved to California (where Brown currently lives). According to E!, a Nov. 1 hearing has been set, and Brown must register with California probation within 72 hours. On that date, Brown's drug test reportedly will again be placed under scrutiny and further clarification will be placed on a discrepancy over Brown's completed service hours.
