Hollywood.com, LLC (“Hollywood.com,” “we,” “us,” or “our”) knows that you care about your personal information, and we strive to respect your privacy.  This Privacy Policy explains how we (including our corporate parents, subsidiaries, affiliates, or related persons or entities) collect, use, and share your personal information when you interact with us via our mobile apps, websites, customer service, or any other service that link to this Privacy Policy (our “Services”).  It does not apply to third-party websites, mobile applications, or services that may link to the Services or be linked to from the Services.  Please review the privacy policies of those websites and applications directly to understand their privacy practices. 

We reserve the right to change this Privacy Policy from time to time at our sole discretion, so please check back periodically for changes. You can review the current version of the Privacy Policy at any time at: http://hollywoodcom.wpenginepowered.com/privacy.  If you do not agree to this Privacy Policy, please do not use our Services.  

2. Information About Children 

The Services are intended for users age sixteen and older. We do not knowingly collect information from children. If we discover that we have inadvertently collected information from anyone younger than the age of 16, we will delete that information. Please contact us with any concerns.

3. Information We Collect 

We may collect information from you in the following ways:

  • Contact Information.  This includes name, email address, phone number, and mailing address.  
  • Payment Information:  Including credit card information. 
  • Registration Information. If you register for our Services (including our mobile apps, websites, newsletters, contests, and giveaways), you may provide your personal information to us.  We collect all of the personal information you provide to us at registration, including your name, email, physical address, phone number, age, and account username and password.
  • Server Log Information. Our servers automatically log certain basic technical information when a user accesses our Services, which may include your Internet Protocol (IP) address, your browser’s request to the Hollywood.com server, the date and time of the request, the language and type of browser you use, certain mobile device information, your geolocation, the referring web page, your computer or mobile device operating system, and any Hollywood.com cookies associated with your browser.  
  • Communications From You to Us.  If you send correspondence or email to us or otherwise communicate with us, we may retain copies of the communications to assist you or for our records.  We may also record customer service (Concierge Service) phone calls.
  • Cookies. When you browse our Services, our system sends a small file called a “cookie” to your computer that identifies your browser.  This allows us to recognize you for purposes of saving your preferences or providing personalized service.  We use cookies to record session information, to record user-specific information on what pages users access or visit, or to customize Web page content based on visitors’ browser type or other information that the visitor sends.  Since we use cookies to make your visit more user friendly, please be aware that refusing cookies may not allow you to take full advantage of some our features.  We also use third-party analytical services such as Google Analytics and those services may use cookies to collect information regarding users that is not personally identifiable.  
  • Social Networking. We may allow you to sign into social networking and other online profiles through Hollywood.com so you can interact with our Services using those accounts. Information about your interests, activities, and employment history from social networks and other places where you choose to share information publicly may be collected.  Hollywood.com can only recognize you through these accounts if you specifically agree to share that information by signing in.
  • Demographic Data. We may access information about you from public sources as well as from third-party sources and platforms (such as databases, online marketing firms, and ad targeting firms) including your age range, gender, location, and interests.
  • Transactional Data. We collect your personal information when you complete a transaction.  This information includes payment card information, other payment details, purchase history, address, membership and loyalty program information, reservations and other appointment information, and personal information about your guests.
  • Saved Preferences.  We may collect your saved preferences when using our Services, including your favorite theaters, seating locations, movies or genres, group sizes, or city or zip code theater preferences.
  • User-Generated Content.  We may collect content that you provide to us, including written comments, ratings, photos, videos, and audio.  Any information you contribute is public, and we do not prevent others from viewing it.
  • Health Information.  We may collect vaccine status or infer disability status when you select wheelchair-accessible seating.  
  • Biometric Identifiers. We may collect data (as permitted by law) such as facial scans and fingerprints.  
  • Advertising Information.  This includes special advertising and other unique identifiers that enable us or third parties working on our behalf to target advertisements to you.  Please be aware that our advertising partners may collect information about you when you visit third-party websites or use third-party apps. They may use that information to better target advertisements to you on our behalf. 
  • Sensitive Personal Information: This includes date of birth or gender. Sensitive personal information will never be disclosed to third parties or used for a purpose that is incompatible with the purpose(s) for which it was originally collected or subsequently authorized by a user, unless you expressly grant permission for the use.
  • Other.  Any other information you submit to us. 

4. How We Use Your Information 

Hollywood.com collects your personal information for the purposes explained in this Privacy Policy, including:

  • Service Functionality. To provide the Services and to communicate with you or respond to a request
  • Service Improvement. To assist the technical support of our Services and to maintain and improve the quality of our Services through auditing, research, and analysis. We also use your personal information to develop new services or enhance existing services.
  • Personalization. To personalize your experience, including across platforms and devices.
  • Advertising and Marketing. To send you Hollywood.com marketing and advertising and to market and advertise for third parties.
  • Security. To protect the property rights or safety of Hollywood.com or its members.
  • Legal Compliance. To comply with legal process, such as warrants, subpoenas, court orders, and lawful regulatory or law enforcement requests and to comply with applicable legal requirements. 
  • Promotional Activities. We may run contests, programs or giveaways in which we ask visitors for contact information (such as their name and email address) and demographic information (such as their zip code or foreign postal area). The user’s contact information is used to contact the user when necessary, such as if they win a contest or to notify users of upcoming contests.

5. Sharing of Information

Hollywood.com may share your personal information with:

  • Affiliates.  We share information with other members of our group of companies. 
  • Service Providers. A person, vendor, or company engaged to perform services for us or to contribute to our Services.  This includes theaters and event providers so they may admit you into the theater or otherwise fulfill the Services.  We also share with analytics and marketing services providers, including entities that analyze traffic on our online properties and assist with identifying and communicating with potential customers. 
  • Business Partners. In the case of contests or giveaways that you participate in, we may share information with a third party who runs the contest, or for shipping purposes. We may also share your personal information with providers of membership or loyalty programs. Hollywood.com, LLC and its’ affiliates may share your personal data with our business partners for marketing purposes.
  • Online Advertising Partners. Advertisers and other third parties in order to better tailor our Services, products, marketing, or advertising. We partner with companies that assist us in advertising our Services, including partners that use cookies and online tracking technologies to collect information to personalize, retarget, and measure the effectiveness of advertising.  
  • Social Media Networks and Platforms. If you interact with us on social media platforms, the platform may be able to collect information about you and your interaction with us. If you interact with social media objects on our Services (for example, by clicking on a Facebook “like” button), both the platform and your connections on the platform may be able to view that activity. To control this sharing of information, please review the privacy policy of the relevant social media platform.
  • Government Entities/Law Enforcement. We may share information when we believe in good faith that we are lawfully authorized or required to do so to respond to lawful subpoenas, warrants, court orders, or other regulatory or law enforcement requests, or where necessary to protect our property or rights or the safety of our employees, our customers, or other individuals.
  • Other businesses in the context of a commercial transaction: We may change our ownership or corporate organization while providing the Services. We may transfer to another entity or its affiliates or service providers some or all information about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction. If Hollywood.com becomes involved in a merger, acquisition, or other sale of its assets, we will ensure the confidentiality of any personal information involved in the transactions and notify you before the information is transferred or becomes subject to a different privacy policy; however, we cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information as described in this policy.
  • Other Business Partners: In addition to the foregoing, Hollywood.com may transfer – in compliance with applicable data protection law – personal data to law enforcement agencies, governmental authorities, legal counsels, insurers, external consultants or business partners.

6. Information Security

Any of your personal information that is stored is kept securely on servers maintained by Hollywood.com’s hosting provider Industry-standard encryption technologies are used when transferring and receiving consumer data exchanged with our site, which encrypts information you input, except for domain name data. You are solely responsible for the confidentiality of your password, if any. We suggest you do not share your password with anyone.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Hollywood.com cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk.

7. Your Options and Rights Regarding Your Information

  • Your Account: Please email support@hollywood.com to update your account information.
  • Email Unsubscribe: If you do not wish to receive marketing information from us or wish to opt out of future email promotions from us, please visit this page or contact us at support@hollywood.com. Please note that all promotional email messages you receive from us will include an option to opt out of future email communications.
  • Do Not Track: Your browser or device may include “Do Not Track” functionality. The information collection and disclosure practices and the choices that we provide to you will continue to operate as described in this privacy policy, whether or not a Do Not Track signal is received.
  • Jurisdiction-specific rights: You may have certain rights with respect to your personal information depending on your location or residency. Please see “privacy disclosures for specific jurisdictions” below. Please contact us to exercise your rights.
  • Nielsen Digital Measurement. Some of our Services include Nielsen proprietary measurement software, which will allow you to contribute to market research, such as Nielsen TV Ratings.  To learn more about the information that Nielsen software may collect and your choices to opt out with respect to it, please see the Nielsen Digital Measurement Privacy Policy at http://www.nielsen.com/digitalprivacy.
  • Ad Choices: You have options to limit the information that we and our partners collect for online advertising purposes.
  • You may disable cookies in your browser or mobile device using their settings menus. Your mobile device may give you the option to disable advertising functionality. Because we use cookies to support Service functionality, disabling cookies may also disable some elements of our online properties.
  • Users may opt out of personalized advertising by visiting Ads Settings.
  • The following industry organizations offer opt-out choices for companies that participate in them: the Network Advertising Initiative, the Digital Advertising Alliance, and the European Interactive Digital Advertising Initiative
  • You may contact us directly.

If you exercise these options, please be aware that you may still see advertising, but it will not be personalized. Nor will exercising these options prevent other companies from displaying personalized ads to you. If you delete your cookies, you may also delete your opt-out preferences.

8. Telemarketing

Hollywood.com LLC is offering a Short Code Messaging Program (the “Program”), which you agree to use and participate in subject to this Section 8 and the terms (“Terms”) of the Program.  By opting into or participating in the Program, you accept and agree to the Terms, including, without limitation, this Section 8.  Any term identified in this Section 8 is limited to the Program and is not intended to modify the other Terms and any privacy policy that governs the relationship between you and Hollywood.com LLC in other contexts.

(a)  Program Description:  Without limiting the scope of the Program, users that opt into the Program can expect to receive recurring messages concerning your relationship with Hollywood.com LLC, including, but not limited to, account-related messages.

(b)  Cost and Frequency:  Message and data rates may apply.  The Program involves recurring mobile messages, which will vary in frequency.  Additional mobile messages may be sent periodically based on your interaction with Hollywood.com LLC.

(c)  User Opt In:  The Program allows users to receive mobile messages by affirmatively opting into the Program.  Regardless of the opt-in method you utilized to join the Program, you agree that this Section 8 applies to your participation in the Program. By participating in the Program, you agree to receive autodialed or prerecorded messages, as described in Section 8(a), at the phone number associated with your opt-in, and you understand that consent is not required to use Hollywood.com LLC’s services or to purchase any Hollywood.com LLC products.  While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of Hollywood.com LLC’s messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”).  Message and data rates may apply.

(d)  User Opt Out:  If you do not wish to continue participating in the Program or no longer agree to these terms in Section 8, you agree to reply “STOP,” “QUIT,” “END,” “CANCEL,” or “UNSUBSCRIBE” to any mobile message from Hollywood.com LLC to opt out of the Program.  You may receive an additional mobile message confirming your decision to opt out.  You understand and agree that the foregoing option is the only reasonable method of opting out.  You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.

(e)  Duty to Notify and Indemnify:  If at any time you intend to stop using the telephone number used to subscribe to the Program, including canceling your service plan or selling or transferring the phone number to another party, you agree that you will complete the User Opt Out process set forth above in Section 8(d) prior to ending your use of the telephone number.  You understand and agree that your agreement to do so is a material part of these Terms.  You further agree that, if you discontinue the use of your telephone number without notifying Hollywood.com LLC of such change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by Hollywood.com LLC, or any party that assists in the delivery of the messages Hollywood.com LLC sends, as a result of claims brought by the individual(s) who is later assigned that telephone number.  This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of Hollywood.com LLC’s Programs.

YOU AGREE THAT YOU SHALL INDEMNIFY, DEFEND, AND HOLD HOLLYWOOD.COM LLC, HOLLYWOOD.COM LLC’S AGENTS, AND ANY THIRD-PARTY SERVICE PROVIDER WE USE TO SEND MESSAGES HARMLESS FROM ANY CLAIM OR LIABILITY RESULTING FROM YOUR FAILURE TO NOTIFY US OF A CHANGE IN THE INFORMATION YOU HAVE PROVIDED, INCLUDING, BUT NOT LIMITED TO, ANY CLAIM OR LIABILITY UNDER THE TELEPHONE CONSUMER PROTECTION ACT, 47 U.S.C. § 227, et seq., OR SIMILAR STATE AND FEDERAL LAWS, AND ANY REGULATIONS PROMULGATED THEREUNDER RESULTING FROM HOLLYWOOD.COM LLC ATTEMPTING TO CONTACT YOU AT THE TELEPHONE NUMBER YOU PROVIDED.

(f)  Support Instructions:  For support regarding the Program, email Hollywood.com LLC at support@hollywood.com.  Please note that the use of this email address is not necessarily an acceptable method of opting out of the Program.  Opt outs must be submitted in accordance with the User Opt Out procedures set forth in Section 8(d) above.

(g)  Disclaimer of Warranty:  The Program is offered on an “as-is” basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage, or other changes made by your carrier.  Hollywood.com LLC will not be liable for any delays or failures in the receipt of any messages connected with the Program.  Delivery of messages is subject to effective transmission from your carrier/service provider/network operator, and is outside of Hollywood.com LLC’s control.  Your or any other carrier/service provider/network operator is not liable for any delivered or undelivered messages associated with the Program.

9. Other Important Information 

  • Where Information is Processed. Hollywood.com processes personal information on the secure servers of a hosting service located in the United States of America.
  • Data Retention. We may store information about you for as long as we have a legitimate business need for it. 
  • Sharing of Medical or Health Information. To the extent that we receive protected health information about you, that information is subject to electronic disclosure to the extent permitted by applicable law.

10. Information for California Residents 

Removal of Comments by California Residents Under Age 18

If you are a California resident under age 18 you may request that Hollywood.com remove from public view comments previously posted by you on our Services. If you’d like to request removal of a comment, please email legal@hollywood.com with the following information: the URL where the content exists and the exact content you would like to remove. Please include “request for removal” in the subject of the email.

The California “Shine the Light” Law 

As required by California law, upon letter or email request by any California resident with whom Hollywood.com has an established business relationship, Hollywood.com will disclose to you each instance, if any, in the immediately preceding calendar year in which Hollywood.com disclosed your personal information to a third party that Hollywood.com knows or has reason to know used your personal information for direct marketing purposes. 

11. Information for Nevada Residents 

Residents of the State of Nevada have the right to opt out of the sale of certain pieces of their information to third parties. We “sell” personal information under Nevada law. If you are a Nevada resident and would like more information about our data sharing practices, please contact us.

Submitting Requests 

You may request to exercise your rights by submitting the form on this page or making a request using the contact information above. If you are a California resident, you may authorize another individual or a business registered with the California Secretary of State, called an authorized agent, to make requests on your behalf.

We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.

All requests for personal data modifications are acted upon in the ordinary course of business, and Hollywood.com reserves the right to retain backup copies of such requests.

We must verify your identity before responding to your request. We verify your identity by asking you to provide personal identifiers that we can match against information we may have collected from you previously. We may need to follow up with you to request more information to verify identity. We will not use personal information we collect in connection with verifying or responding to your request for any purpose other than responding to your request.

13. Miscellaneous

If any provision of this Privacy Policy is deemed to be void, voidable, invalid, or unenforceable, the remaining portions of this Privacy Policy shall be severable and shall remain in full force and effect.
