Jerry Heller’s attorney seeking to continue Straight Outta Compton lawsuit

The attorney for the former N.W.A. manager Jerry Heller is trying to get permission to pursue his late client’s Straight Outta Compton defamation lawsuit.
The former manager took legal action against the makers of the 2015 N.W.A. biopic, including Dr. Dre and Ice Cube, last year (15) over his portrayal as a ruthless record label boss, played by Paul Giamatti.
The rappers, plus director F. Gary Gray and bosses at NBCUniversal, sought to dismiss the lawsuit and most allegations in Heller’s complaint were thrown out, but he was allowed to continue his defamation claim regarding scenes which showed him discouraging an artist against getting a lawyer during contract negotiations.
However, it seemed uncertain if the lawsuit would continue as Heller passed away last month (Sep16) after suffering a heart attack while driving, causing him to crash his vehicle. He later died from his injuries, aged 75.
His attorney Michael Shapiro has asked for a stay of the lawsuit until 20 October (16) and is asking to get the court’s permission to pursue the case in the name of a successor in interest, according to The Hollywood Reporter. However, no successor has yet been named so the case may not be able to proceed.
