Cardi B seeking dismissal of cover art lawsuit

Rapper Cardi B’s attorneys are asking a judge to dismiss a lawsuit filed over her album cover art.

Kevin Michael Brophy, Jr. is suing the Bodak Yellow hitmaker for $5 million, claiming she used his image on the cover of her Gangsta Bitch Music Vol. 1 mixtape without his permission. According to The Blast, Brophy, Jr. is alleging he never met Cardi B or posed for the racy picture, in which his head is between her legs.

He was only able to determine she used his image when he spotted the tattoo on his back.

The rapper’s lawyers have now responded to the lawsuit, arguing Brophy, Jr. is seeking “whatever piece of Cardi B’s income he can gouge out, and whatever free ride on her famous coat-tails he can gain, through extortionate means of this unfounded, preposterous action”.

They also insist the photo is a “classic example of transformative work created in the exercise of the First Amendment rights of the photographer” and since Brophy, Jr. was not identified, his image has not been harmed.
