Katie Holmes Gets Primary Custody — Suri Won’t Be Living with Tom Cruise

ALTKatie Holmes and Tom Cruise‘s divorce is turning out to be no battle at all. Instead of putting up a fight for custody, Cruise has reportedly agreed to let their 6-year-old daughter Suri reside with Holmes in New York City, People is reporting. But, Cruise is sure to get plenty of visitation with his daughter.

The issue of physical custody was reportedly included in the settlement that the former couple reached on Monday. “They both love their daughter,” a source says. “And Tom thinks she should be with her mother.”

It seems that Cruise didn’t want this divorce to turn into a nasty battle (focused on by the media) that would hurt his daughter. “[Cruise] didn’t want his family dragged through the mud,” the source states. “Neither one of them wanted this to be hashed out in public.”

Sources add that Holmes plans to enroll Suri in a private school in NYC this fall. This is a big change for the little girl who has for so long been educated by tutors.

“We are committed to working together as parents to accomplish what is in our daughter Suri’s best interests,” Cruise and Holmes’ reps released in a statement on behalf of their clients after the settlement had been reached. “We want to keep matters affecting our family private and express our respect for each other’s commitment to each of our respective beliefs and support each other’s roles as parents.”
