Robert Downey Jr.’s lawyer has a message for the California court system: Set my client free. Ross Nabatoff says the 34-year-old actor, sentenced to three years in prison on drug charges last year, is entitled to be released due to a legal technicality, according to The Associated Press. But state prosecutors say it’s bogus.
“He’s served a year, and he should have been out in February,” said Nabatoff, who pleaded his case in a state appeals court Thursday. “This is a sad tale.”
Nabatoff says that the sentence Downey’s now serving should have been reduced because he’d already served some time for three previous misdemeanor sentences for driving under the influence, carrying an unloaded weapon and being under the influence.
An official with the state Attorney General’s Office told AP that the legal circumstances cited by Downey’s lawyer don’t apply.
