Robert Downey Jr. is not guilty, and that’s the story he’s sticking to.
The actor’s lawyer, Robert Waters, who helped secure Downey’s release from prison, says he and his legal team will “vigorously defend” their client against drug charges stemming from his arrest last month in Palm Springs, Calif., Reuters reports. Their plan calls for Downey to enter a plea of not guilty.
No further specifics to their strategy was provided. However, there is speculation that the actor’s lawyers will try to prove that police officers unlawfully entered Downey’s hotel room where they found 4 ½ ounces of cocaine. This might prove to be their biggest challenge since police say Downey gave them consent to enter his hotel room and conduct a search.
Downey, 35, was arrested in the Palm Springs hotel after an anonymous caller alerted police to a man who had drugs and firearms in his hotel room.
During their search of Downey‘s room, police found a small amount of drugs but no firearms.
Drug tests performed on Downey also came back positive. The Oscar-nominated actor awaits trial Dec. 27 in Indio.
The actor remains free after posting $15,000 bail. Most recently, Downey checked himself into an L.A. area hospital for depression last weekend.
He’s scheduled to complete shooting two more episodes of “Ally McBeal” to complete his 10-episode commitment.
