Old rock bands never die. They just wait around for 20 years, until a super-successful TV show comes along and borrows their name, then they try to sue the pants off the makers of that show. One of the founding members of Survivor (the 1970’s rock band) is taking legal action against the CBS hit show (you guessed it) “Survivor.” It seems the producers have plans to release a “Survivor” soundtrack CD, but guitarist Franklin Sullivan III is asking a federal court in Chicago for a preliminary injunction, claiming trademark infringement.
Hmmm. Let’s see. People are going to buy the “Survivor” soundtrack CD under the mistaken impression that it’s got that “Eye of the Tiger” song from “Rocky III” on it?
CODA: Douglas Allen Woody, former bassist for the Allman Brothers Band, was found dead Saturday in a Queens motel, according to New York police. Woody, who was 44, joined the Southern rock outfit after the group re-formed in 1989.
COMPOSER DIES: Rock composer Jack Nitzsche, who made a name for himself by working with Neil Young, the Rolling Stones and Phil Spector, died Friday from a bronchial infection in Hollywood. He was 63. Nitzsche also co-wrote the theme song to “An Officer and a Gentleman.”
